Covenants for Luna Beach Resort Homes and Lots
Rules and Regulations
- All owners must take their trash to the trash to the bin that is designated to them. All trash must be in Plastic bags. No, trash barrels nor trash cannot be visible on any property.
- No burning of any kind is allowed.
- Quiet hours are from 10:00 P.M. to 7:00 A.M.
- There will be no parking other than what is designated to the Property owner.
- If Property Owner desires to rent out their property then the renter must abide this Covenant for Luna Beach Resort or the Property Owner will be held responsible for any fines or lean.
- All Property Owners have Walking access thru Luna Beach Resort area of the homes and lots.
- All Property Owners have Beach/walking access only thru the designated path given to them.
- All dogs must be on a leash.
- All homes built on lots must not block any sea view from any home behind them.
- All homes must be built no less in size than 2,000 Sq. Ft.
- All home and land owners understand that NO business Operation can be established on any property. All properties are only for residential purposes.
- All lots are only allowed one home per lot.
- All lots with road access must get approval from Seller before construction of road for approval of property lines and road access.
- All road access is only for designated home or land owner no boarding properties to the North or South of Luna Beach Resort may use designated road access.
- All Water hook up must go thru the Seller, unless property owner digs their own well on their property.
- All Electric hook up must go thru Seller or your Electrician must have prior permission from Seller.
- No Water Cisterns will be allowed.
- Fencing of any kind will not be allowed.
- No, unattached structure from any home will not be allowed.
Violations of Covenant
All rules and regulations that are broken the Property Owner is subject to either a warning, a fine or a lien on their property.
By signing this you as a Property Owner/future Owner have read and are in agreement of the Covenants and terms.
Home Owners Association (HOA’s)
All home owners:
Water will be $50.00 per month – Paid to Seller. All late payments per month will be charged an additional amount of $15.00. If a home or land owner exceeds the normal use of water then there will be a meter put on at owners expense of the meter.
All lot owners:
Water will be $50.00 per month – Paid to Seller. All late payments per month will be charged an additional amount of $15.00. (This only applies to those who are hooked up for water). If and when water is hooked up to the property and the owner exceeds the normal use of water then there will be a meter put on at owners expense of the meter.
After 70% of all homes and lots are sold at Luna Beach, the Owner of Luna Beach Resort will then turn over the common area (per survey) to all the home and lot owners. They then can form their own HOA for Luna Beach Resort.
